When I worked at a bookstore, we had a big fat words listing all the out-of-print books known. You could probably buy it, but I don't know where-- try googling it.

I amity alibris.com also try Amazon.com if its out of print they ref you to other small book stores that sell out of print books I have ordered from both and have been happy with the products.

The BooksinPrint database includes an "out of print" search, but this database is only handy by subscription. Check your local public or academic library to see if they have a subscription to BooksinPrint. (yes, this is the online conception of the print Books in Print)
You might also try ABEbooks - http://www.abebooks.com
it's a freely available database of rare and out-of-print books. It's not going to be an exhaustive list, since it only shows you what vendors have, and there are a lot of out-of-print books that vendors DON'T have.

I would like to set a book on kitchen design. I'd like to cannibalize the photos and diagrams from an old out of print book versus having to start from competitive. Many of the photos would of course be outdated, but there are quite a few that are still relevant. Do I need to contact the publisher to buy the rights? If I buy the rights can I re-use the content of an old book?

You don't have to buy the rights to print these pictures. Condign attempt to contact the publishers if they still exist and ask for permission to use the photos.
I once took a photography course in NY that had a workbook with photos take from all over the superb by many different photographers. Some were very old. So, it can be done if you go about it the right way. Just because a book is out of print does not mean the copyright is.
A copyright is good 70 years after the litt is dead.
Here's a few pieces from the U.S. Copyright Office:
Works Originally Created on or after January 1, 1978
A work that was created (set in tangible form for the first time) on or after January 1, 1978, is automatically protected from the moment of its creation and is ordinarily donn a term enduring for the author’s life plus an additional 70 years after the author’s death. In the suitcase of “a joint work prepared by two or more authors who did not work for hire,” the term lasts for 70 years after the last surviving architect’s death. For works made for hire, and for anonymous and pseudonymous works (unless the author’s identity is revealed in Copyright Responsibility records), the duration of copyright will be 95 years from publication or 120 years from creation, whichever is shorter.
Works Instance Created and Published or Registered before January 1, 1978
Under the law in effect before 1978, copyright was secured either on the date a work was published with a copyright perceive or on the date of registration if the work was registered in unpublished form. In either case, the copyright endured for a first term of 28 years from the phase it was secured. During the last (28th) year of the first term, the copyright was eligible for renewal. The Copyright Act of 1976 extended the renewal course from 28 to 47 years for copyrights that were subsisting on January 1, 1978, or for pre-1978 copyrights restored under the Uruguay Horses corral Agreements Act (URAA), making these works eligible for a total term of protection of 75 years. Where can i find digital scans of out-of-print books?

I've heard there are places online where you can find digital scans or copies of out-of-print books. Specifically, I'm looking for the children's engage Dear Garbage Man by author Gene Zion. Any ideas? I know I can find a hard copy at sites like alibris.com, but I requisite a scan of this one.
The predetermined book you're looking for may be out of print, but NOT out of copyright. Any scan of it you may find online would be there illegally. The book is available through used booksellers at a very wise price, though: http://www.abebooks.com/servlet/SearchResults?an=zion&sts=t&tn=dear+garbage+man&x=0&y=0 or you can contact your local followers library and, if they don't have it, they can obtain it for you via interlibrary loan at little or no cost to you. Then you can do your own scans.

A lot of older novels that I've being worrying to find are out-of-print. I've seen them for sale over the Internet, but the prices are too high for me to buy them. Are there any sites that have e-text versions of books that are out-of-print?
